Motorola wins injunction against Apple iOS devices

In past, Apple has faced many lawful problems and now it has been kicked into a new one by Motorola as Motorola has won a certain preliminary injunction against some of the Apple products. It’s not the first time when Motorola has caused a problem for Apple.

The injunction has practically affected devices with GPRS connectivity.  The gadgets named in this injunction are iPhone, iPhone 3G, 3GS, 4, iPad 3G and iPad 3GS,  but whereas the iPhone 4GS is exceeding the Motorola’s patents as well but the fact was observed later on after the suit was filed so it was not mentioned in an explicit manner.

Motorola has not yet won the case, but if they want, they can enforce the injunction to Germany and to do that, Motorola has to sign a €100 million bond. This is a big risk for Motorola Company and means if Apple wins the suit, Motorola will have to pay €100 million to Apple. Apple might appeal and win a stay of this injunction.

 Motorola’s patent for GPRS connectivity has remarkable energy and of course Apple can not go forward without it and so Motorola may have to offer a license to Apple for GPRS but somehow, the lawyers of Motorola have managed not to do this right now at least before Apple pays off for the damage done far beyond repair, that is starting from 2007. Whereas Apple is not at all ready to pay for any damage which can cause costly circumstances for Apple and instead Apple is trying to nullify the Motorola’s patent and solve their problem this way.

 In the United States, Apple has already been sued for exactly the same patent too. Anyway, the next hearing of the case is going to be on February 2012 which would probably conclude the suit.
